DUI is probably the most common criminal offense across the nation. Make no mistake. DUI is a crime. It is not a traffic violation. It is a crime and punishable with imprisonment.

If you have been charged with DUI, you must exercise your rights. Failure to exercise your rights can be self defeating. By exercising your rights you can ensure that your interests are protected.

 

First of all, you must exercise your right to remain silent. Just because the police officer is questioning you, it does not mean that you have to respond to the officer. Remember, the police officer is more interested in getting a conviction than knowing the answers. If it makes sense for the officer to use your answers as evidence against you, you can rest assured that he will use it as evidence.

 

Make a mental note of everything the officer does once he stops you for DUI. Police officers must follow certain procedures when stopping motorists for DUI. Similarly the officer must follow certain procedures when arresting a DUI suspect. If any of these procedures are not followed, the DUI stop and the subsequent arrest will be illegal.

 

As a DUI defendant, you have the right to have an attorney represent you. When you are taken to the police station after you are placed under arrest, inform the officer that you want to speak to your attorney. They must let you speak to your attorney. It is a right guaranteed by the Constitution.
