DUI and Adjusting Status

Posted on:2/18/2013
DUI is the most common crime in the United States. Police officers often stop drivers if they suspect the driver is driving under the influence. If you have been stopped for DUI, don't argue with the officer.

He has probably made up his mind to arrest you for DUI and by arguing with him, you will only be making his job easier.

If you are an immigrant and looking to adjust your status, a DUI conviction can result in your application for adjustment of status being denied. Contact a seasoned DUI attorney if you have been charged with DUI. A DUI charge is not a traffic offense. It is a crime.

When you apply for adjustment of status, the USCIS will conduct a background check. Your DUI conviction will show up during the background check. Under US immigration law, you will be considered as having a DUI conviction even if there is no formal conviction. Even a guilty plea will be considered a conviction. Participation in a diversion program is also considered as conviction. Never take a DUI charge lightly. Seek the assistance of an experienced DUI attorney.

If you have been charged with DUI, you may have defenses available. Do not answer any of the questions the arresting officer asks you. Remember anything and everything you say can and will be used as evidence against you. It will affect your chances of adjusting your status in the United States. Exercise your right to remain silent. Contact an experienced DUI attorney immediately.
