When you consume alcohol, the alcohol does not go straight to your brain and impair it immediately. It takes time. In some persons, it can take a very long time. The blood test is never done at the time of the DUI stop. It is done subsequently at the police station. 


Your DUI attorney will demonstrate to the court using scientific techniques that generally the human blood takes a while to absorb the alcohol that has been consumed and that it takes more time for the alcohol to reach the brain after it has been absorbed in the blood. The time period between the DUI stop and the blood test is sufficient for the blood to absorb the alcohol. So the result will show a high blood alcohol concentration which will be higher than what it was when you were stopped. So it is possible that when you were stopped your blood alcohol level was below the legal limit but in the time gap between the DUI stop and the blood test, your blood absorbed the alcohol.
