DUI and Exclusion from Canada

DUI is a serious criminal offense in the United States and in most countries across the world. Canada has taken a tough stance against drunk driving. If you have been convicted for DUI in the US or anywhere else, you may be ineligible for entry to Canada. Many people who are unaware of this rule end up being turned away at the port of entry.

In the United States, in most states a first time DUI is a misdemeanor offense. Misdemeanor offenses are punishable with fine and imprisonment not exceeding one year. However in Canada, DUI is an indictable offense. There are no exceptions. Even a first time DUI offense is an indictable offense.


Under the Canadian immigration law, anyone committed of a crime that would be an indictable offense if committed in Canada or an indictable offense under the law of the country where the offense was committed can be barred from entering Canada.


If you have been convicted of DUI, you can overcome the legal bar to your entry to Canada. There are steps you can take to over this entry restriction. You can apply for deemed rehabilitation at the port of entry. For this you must show that you one had one DUI conviction and that more than 10 years have elapsed since you completed the sentence.
