DUI stands for driving under the influence. In some states it is referred to as DWI or driving while intoxicated. Intoxication does not mean drunk.


DUI stands for driving under the influence. In some states it is referred to as DWI or driving while intoxicated. Intoxication does not mean drunk.

 

The legal definition of intoxication includes a person who cannot make normal use of physical or mental faculties because of any substance in the body. This substance can be alcohol, prescription or illegal drugs, any other substance or a combination of substances.

 

For DUI/DWI offense, intoxication means a blood alcohol concentration of 0.08 or more. To have a blood alcohol concentration of 0.08, a person of 150 pounds would have to consume about four beers or mixed drinks in one hour.

 

The blood alcohol concentration limit for a DUI/DWI offense is the state across the United States. Most states have a zero tolerance policy towards underage DUI. In case of an underage driver, there is no blood alcohol concentration requirement. Even one drop of alcohol is sufficient for a underage DUI/DWI offense.

 

DUI/DWI involves a person driving or operating a motor vehicle in public place while intoxicated. Parallel laws make it illegal to operate an aircraft or watercraft while intoxicated.

 

DUI/DWI is a misdemeanor offence. The minimum punishment is increased if the driver had an open container of alcohol in his or her immediate possession. The punishment is also enhanced if there is a minor present in the vehicle. In some states a third and subsequent DUI/DWI offense is a felony offense.
