DUI or driving under the influence is a serious offense. To be charged with DUI, you must be caught operating a vehicle while your blood alcohol concentration is 0.08 per cent or higher.


The definition of operating a vehicle will depend on state law. In some states, merely being in the car with the ignition switched on is sufficient to meet the requirement for operating a vehicle. In some states, the person must be in physical control of the vehicle.


The definition of vehicle generally includes all motorized vehicles including all automobiles and farm vehicles. In many states riding an animal drawn vehicle while under the influence is an offense.


If you have been arrested for DUI, you will be taken to the police station and the formalities will be completed. You will then be produced in court and you will be released on bail. You must appear in court on the next hearing date. If you do not appear, your bail will be cancelled and you will be arrested.


Your DUI trial will be like any other criminal trial. You can hire your own attorney. You can testify in support of your case as well as get others to testify for you. You can also cross examine the police officer who arrested you. You can challenge the evidence against you. In a nutshell, the burden is on the police to prove the offense.
