DUI and Entry to Canada

If you have been convicted of DUI, you can overcome the legal bar to your entry to Canada. There are steps you can take to over this entry restriction.


You can make an application for deemed rehabilitation at the port of entry. For this you must show that you one had one DUI conviction and that more than 10 years have elapsed since completion of your sentence.


If you have two DUI convictions, you can apply for streamlined rehabilitation. You must show that at least 5 years have passed since the completion of your sentence. For both deemed and streamlined rehabilitation, you must prove that your DUI offense is a misdemeanor and the circumstances of the offense are such that it would not be considered a serious criminality if it occurred in Canada.


Generally a felony crime under US law would be considered a serious criminality in Canada. Also the offense should not have caused any bodily injury to any person or property damage. You must provide court documents of the conviction and proof of completion of your sentence. You must also provide a recent identification record from the FBI and a police report from the state where you have lived for more than 6 months in the last 10 years.


If you are ineligible for deemed or streamlined rehabilitation, then you can apply for an approval of rehabilitation to the Canadian Embassy or Consulates after 5 years from the date you completed the sentence.
