DUI and Insurance

A DUI conviction can adversely affect your insurance rates. Insurance is based on risk. Insurance companies consider a person having a DUI conviction as high risk. Even if it is your first DUI conviction, your insurance rates will increase.

You cannot conceal your DUI conviction from your insurer. When you apply to renew your insurance policy, the insurance company will run a background check. Your conviction will show up in the background check.


You can't prevent the increase by changing your insurance company. Every time you apply to a new insurance company, the company will run a background check on you. The background check will reveal your DUI conviction.


Many insurance companies have a clause in the policy that provides for automatic cancellation of the policy in case of a DUI conviction. Many states have administrative license suspension for DUI offender. This is independent of the DUI case against you. If your license is suspended following a DUI arrest, most states require you to get a form signed by your insurance company before reinstating your license. So your insurance company will come to know of your DUI arrest even if you do not inform them.


Generally you can request a hearing before the suspension of your driver's license. You manage to convince the administrative officer that your license should not be suspended, you will retain your license but you must still fight the DUI charges against you in order to prevent your insurance rates from shooting through the roof.
